Local previously arrested now indicted on child porn charges; AG's office issues release

Posted

The Advocate first reported about this arrest in January after obtaining a citation.
We are sharing the release below in light of the indictment and a release issued by the Attorney General's Office today.

Attorney General Russell Coleman and Ashton McKenzie, the Commonwealth’s Attorney for the 21st Judicial Circuit, announced today action by the Attorney General’s Department of Criminal Investigations (DCI) and the Commonwealth’s Attorney Office resulted in an indictment of a child predator.

A Montgomery County Grand Jury indicted Justin Eller, 38, on 12 felony charges including Possession and Distribution of Child Sex Abuse Material (CSAM). Most of the videos allegedly involved children between the ages of 12-18, but at least one was a child under the age of 12 involved in sexual activity.

The Montgomery County Sheriff’s Office arrested Eller, of Mt. Sterling, during a traffic stop following a DCI investigation. DCI opened the investigation in December after receiving tips generated by the National Center for Missing and Exploited Children.

The Kentucky Attorney General’s DCI was assisted by the Commonwealth’s Attorney Office for the 21st Judicial Circuit, the Montgomery County Sheriff’s Office and the Madison County Sheriff’s Office.

The Kentucky Supreme Court’s rule on trial publicity limits information the Office can provide publicly.

The charges in an indictment are allegations, and the defendant is presumed innocent unless and until proven guilty.
